Accordingly, HCMC People’s Council – People’s Committee, Vietnam Fatherland Front –HCMC, Parliament Delegation of HCMC and People’s Committees of 24 districts will collect public opinions of congressmen, government officers, experts, scientists, political-social organizations and mass people of HCMC.


The content of public poll focuses on the draft amended criminal code, especially on 8 specific points: criminal liability of legal entity; scope of criminal liability of adolescents and measures to be used instead of criminal treatment toward adolescent criminals; the elimination of death sentence on several offences; replacing money punishment or unjailed education by fixed –term imprisonment (Article 35 and 36); expulsion: replacing intentional acts against the State’s economic management regulations   and causing serious consequences by specific offences in economic field; applying criminal liability to acts such as stealing assets under VND 2 million; elimination of some criminals and supplement some new criminals.


The public poll on the draft amended criminal code will take place from August 20 till Sep 7 2015 under forms of collecting public opinion by written documents, organizing seminars, talks or conference through HCMC Department of Justice’s website at www.sotuphap.hochiminhcity.gov.vn


Addressing at the conference, Mrs. Nguyen Thi Quyet Tam said the draft amended criminal code has been discussed by the National Assembly many times but still not concluded due to different opinions. This is a very important criminal code involving human rights, so it should be cautiously issued and closely based on theory and reality. The policy of the National Assembly on collecting public opinions aims to seek wisdom and the will of people to make Penal Code come into life with no controversies.
